Court Orders Kaguchia’s Release, But Police Yet to Comply
The High Court in Kiambu has ordered the immediate release of Mukurwe-ini MP Hon. John Philip Gichohi Kaguchia from police custody.
In a ruling delivered on 3rd August 2026 by Lady Justice Njoki Mwangi, the court directed that the MP be released forthwith upon deposit of a police cash bail of KSh 100,000.
The court also ordered that:
The application be served on the respondents
The respondents file their responses within 14 days
The matter be heard virtually on 16th September 2026
Kaguchia had been arrested following remarks he made during a political rally, which authorities described as allegedly inflammatory.
Despite the court order, reports emerging this evening indicate that the MP is still being held at Kamukunji Police Station. Former Deputy President Rigathi Gachagua and other leaders have accused the Officer Commanding Station (OCS) of ignoring the court order even after it was served.
Questions on the ground:
Why has the court order not been complied with hours after it was issued?
Will the police eventually release the MP as directed by the court?
What does this situation say about the relationship between the Judiciary and the Police?
Likuyani Digest will continue monitoring the situation.
Stay informed. Stay ahead.
